THESE TERMS AND CONDITIONS OF CARRIAGE GOVERN ALL SERVICES PROVIDED BY NSFH – NONSTOP FREIGHT HAULING, LLC. BY TENDERING A SHIPMENT TO US, YOU AGREE TO BE BOUND BY THESE PROVISIONS.
1. Definitions
Unless otherwise stated, the following definitions apply:
- Carrier: Refers to NSFH – Nonstop Freight Hauling, LLC.
- Shipper: The party tendering the cargo for transportation, including their agents and representatives.
- Consignee: The party designated to receive the freight at the final destination.
- Shipment: The specific quantity of goods and materials accepted by the Carrier from a single Shipper at one time for one destination.
2. Agreement to Terms
The act of tendering a shipment to NSFH for transportation constitutes the Shipper's absolute acceptance of all terms and conditions set forth herein. No employee or agent of NSFH is authorized to modify these terms orally.
3. Scope of Services
NSFH provides road freight and cargo transportation services for general, non-hazardous commodities. We reserve the right to refuse any shipment that is improperly packaged or poses a risk to equipment and safety. All logistics services are performed with the commitment to 'Nonstop' efficiency and professionalism.
4. Shipper Obligations
The Shipper is responsible for ensuring all cargo is adequately packed for safe transportation on standard road freight equipment. Shipper warrants that the descriptions, weights, and counts provided on the Bill of Lading (BOL) are accurate. Any failure to provide accurate documentation may result in service delays or additional fees.
5. Payment Terms
All invoices are due and payable within 15 days of the invoice date unless otherwise specified in a separate written agreement. Overdue accounts are subject to a late fee of 1.5% per month. NSFH reserves the right to suspend services for any customer with an outstanding balance beyond the agreed credit terms.
6. Freight Liability
Carrier liability for loss or damage is governed by the 49 U.S.C. § 14706 (the Carmack Amendment). Liability is limited to $0.50 per pound or $100,000 per shipment, whichever is less, unless the Shipper declares a higher value and pays the corresponding excess valuation charge. Carrier shall not be liable for losses caused by: (a) Acts of God; (b) Public Enemy; (c) Authority of Law; (d) Acts of the Shipper; or (e) Natural shrinkage or inherent vice of the goods.
7. Claims Procedure
Freight claims for loss or damage must be filed in writing with NSFH within nine (9) months of the delivery date. Claims for concealed damage must be reported within 48 hours of delivery. All original packaging must be retained for inspection.
8. Lien Rights
NSFH shall have a general and specific lien on any and all cargo in its possession for all charges and expenses due and owing by the Shipper, Consignee, or owner of the goods. This include charges for current shipments as well as prior unpaid balances.
9. Governing Law
These terms and the relationship between NSFH and its clients shall be governed by the laws of the State of South Carolina. Any legal action arising from these terms shall be brought in a court of competent jurisdiction in Richland County, South Carolina.
10. Entire Agreement
This document constitutes the entire agreement between NSFH – Nonstop Freight Hauling, LLC and the customer. These terms supersede any prior oral or written representations or agreements regarding the carriage of freight.
